nuisances, preservation of health, and suppression of vice and
immorality therein.
306. They may lay an equal tax upon the property within the
town to such amount as may from time to time be deemed neces-
sary for the uses of the corporation, and may appoint a collector
to collect the same, prescribe his term of office, responsibility and
compensation.
307. The collector so appointed shall collect the tax levied by
the corporation, and pay the same to the burgess and" commis-
sioners, and shall have the same power to distrain therefor as the
collectors of county taxes.
308. The burgess shall be treasurer of the corporation, and
shall give bond to the corporation, with security, to be approved
by the commissioners, or a majority of them, in such penalty as
they shall prescribe, conditioned for the faithful discharge of his
duties as treasurer, and he shall receive and pay away all moneys
according to the ordinances of the corporation.
309. The burgess and commissioners may direct by ordinance
all or any of the footways in said town to be laid off, levelled,
paved or mended with any materials they may think proper, at
the expense of the proprietors of the different lots before which
the same shall be done.
310. If the proprietors of any house, lot or part of a lot, so
directed to be paved, mended or levelled, shall not reside in the
town, the tenant or person having charge of said lot shall cause
the same to be done, and the money expended by such tenant by
order of the burgess and commissioners, shall be allowed by the
owner of such house, lot or part of a lot, and deducted from the
rent due or to become due.
311. If the tenant of such house, lot or part of a lot, shall
neglect or refuse to have such footway paved, levelled or mended,
•when directed by the corporation, the burgess and commissioners
shall cause the same to be done, and may collect the expense
with the cost from the owner of such house, lot or part of a lot,
by distraining and selling the same.
312. All fines and forfeitures under the ordinances of the said'
corporation, shall be recoverable before the burgess or any justice
