respective offices shall be declared duly elected, and if at any
election any two or more persons shall have an equality of votes,
by which no choice shall be made, a second election shall be held
after not less than ten days' notice, and so on until a choice shall
be made.
300. If, during the year for -which they were elected, the
burgess, assistant burgess, or any of the commissioners shall
die, resign, remove from said town, or be won compos mentis, or
displaced, an election to fill the vacancy shall be held after ten
days' notice, and all persons qualified to vote at a regular may
vote at any special election in said town.
301. The persons so elected shall, before entering upon the
duties of their respective offices, make oath before some justice
of the peace for Washington county, that they will discharge
the duties of their respective offices without fear, favor, affec-
tion or partiality; a copy of which oath, with the certificate of
the justice administering the same, shall be entered on the
journal of the corporation.
302. The burgess and commissioners may meet from time to
time, as often as occasion may require, upon the business of the
town, not less than once in every three months; the burgess
shall preside at such meetings, and shall have the privilege of
the casting vote only; in his absence the assistant burgess shall
preside, under the same restrictions; but when the burgess is
present the assistant burgess shall have the same power as a
commissioner.
303. The burgess and commissioners may appoint a clerk and
assign his duties, and allow him such compensation as they may
think proper.
304. The clerk shall enter all ordinances passed by the burgess
tod commissioners in a book to be kept by him for the purpose,
and the said ordinances shall at all times be open to the inspec-
tion of all persons interested; copies of all ordinances shall be
put up at the most public places in said town.
305. The burgess and commissioners may from time to time
make such by-laws and ordinances as they may deem expedient
for the comfort, health, convenience and prosperity of the town
and the inhabitants thereof; for the prevention and removal of
