928 WASHINGTON COUNTY. - [ART. 21.

if convicted, may fine the party not exceeding ten dollars, and,
in default of payment of the fine and costs, may commit the
offender to the jail of Washington county for a term not exceed-
ing twenty days; but any person convicted may appeal from the
judgment of the justice of the peace to the Circuit Court for
Washington county; and the said corporation shall be liable for
all jail fees of persons so committed.

. SHEBIFF.

292. The sheriff of said county shall be entitled to twenty-five
cents per day for keeping each prisoner that may be confined in
the jail of said county.

293. He shall be entitled to fifty cents each for the delivery
to the trustees of the poor of certificates of their appointment.

294. The county commissioners of said county shall not
allow or order the payment of any account for fuel, paper or
stationery for said sheriff.

SMITHSBTOO,.

295. The citizens of the town of Smithsburg, in Washington
county, are a body politic by 'the name of " The Burgess and
Commissioners of Smithsburg," and by that. name may sue and
be sued, and may have and use a common seal.

296. The bounds of said town are as described on a plat
thereof, made by the burgess and commissioners, under the
authority of the General Assembly of this State.

297. The free white male citizens of said town, of the age of
twenty-one years and upwards," who have resided therein for
twelve months next preceding the election, shall annually, on
the first Monday in May, elect, by ballot, a burgess, assistant
burgess and three commissioners, qualified in all respects as the
voters.

298. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
inconsistent with this charter.

299. In every election for burgess and commissioners, those
persons who shall receive the highest number of votes for the
