116. The judges shall count the votes and declare the result of
the election on the day on which the votes are taken, and shall
make a return of the said election and of the names of the per-
sons elected, and the respective offices for which elected, when
the election is for mayor and couneilmen, to the clerk of the
Circuit Court for Washington county, to be by him entered
among the records of the county; and the said clerk shall
receive therefor, from the mayor and council of said town, the
same fees as he is entitled to by law for similar services.
117. Each judge and clerk of election shall receive two dollars
for holding the same, to be paid by the mayor and council.
118. In case of the death, refusal, disqualification, or removal
of the mayor or any of the council out of the said town, the
council for the time being shall elect a mayor or councilman for
the residue of the term.
119. Each councilman, before he enters upon the duties of his
office, shall make oath before some justice of the peace for
Washington county, that he will faithfully and honestly to the
best of his skill and judgment exercise the powers given and
discharge the duties required of him by law, as councilman for
Hagerstown, impartially, and without favor or resentment to
any, and without delay.
120. The council shall meet at least four times in every year,
on the third Monday in April, June, September, and December,
and oftener if they deem it necessary; the mayor when present
shall preside at all meetings of the council, and he may summon
them to convene whenever it may appear to him that the
interest of the corporation may require their deliberations;
three couneilmen shall constitute a quorum for the transaction
of business. •
121. The council, or a majority of them, shall have power to
appoint their clerk and prescribe his duties, and to allow him a
salary not exceeding the sum of sixty dollars per annum.
122. They shall appoint a treasurer for the corporation, and
allow him such a fixed annual salary as they may deem proper,
and the treasurer shall give bond to the corporation, with
security, approved by the mayor and council, or a majority of
