900 WASHINGTON COUNTY. [ART. 21.

of Maryland for twelve and in the said town for six months im-
mediately preceding the election, shall, on the second Monday of
April in every second year, elect one person not under twenty-
five years of age, and being seized in fee, or for life, of a free-
hold estate situate in said town, a mayor of said town for two
years from the day of election.

112. The said town is divided into five wards, and the in-
habitants of said town, qualified as prescribed in the preceding
section, shall also, on the second Monday of April, annually,
elect five* persons, having the same qualifications in all respects
as those prescribed in the preceding section for mayor, one for
each ward in said town, as councilmen, to serve for one year
from the day of election.

113. Any two justices of the peace for Washington county,
residing in Hagerstown, shall be judges of said election, and
each shall, before he proceeds to act, take the following oath:

"I, A. B., do swear that I will permit all persons to vote who
shall offer to poll at the election now to be held for mayor and
councilmen (or councilmen) of Hagerstown, who, in my judg-
ment, is entitled by law to vote at said election, and that I will
not admit any person to poll at the same election who is not, in
my judgment, qualified to vote, and will in all things execute the
office of judge of the election according to the best of my know-
ledge, without favor or partiality, so help me God."

114. The judges of election shall appoint one or two clerks,
in their discretion, to register the votes taken at such election,
who, before they proceed to act as such, shall each take the
following oath: " I, A. B., do swear that I will well and faith-
fully, without favor, affection or partiality, execute the office of
clerk of the election now to be held, according to the best of
my knowledge, so help me God."

115. The election shall be opened at ten o'clock in the morn-
ing, and be kept open and continued without adjournment until
four o'clock in the afternoon of the same day, and the person
having the highest number of votes for the several offices of
mayor and councilmen, or the highest number of votes for
councilmen, if the election be for councilmen only, shall be
declared duly elected.
