176. If any swine belonging to the inhabitants of said town
or the owners of such lots shall be found going at large within
said town, or within half a mile thereof, any person may im-
pound the same, and shall give notice thereof by advertisement
set up at the most public places in the town, describing the swin&
so impounded.
177. If the owner shall not, within ten days after such adver-
tisement, prove his property, and make compensation for the
injury, if any, sustained by any inhabitant of said town, to be
ascertained by two disinterested persons, inhabitants of said
town, and shall not pay for every swine impounded to the person
impounding the same the sum of twenty-five cents for every day
it shall have been so impounded, the person so impounding may
sell or kill such swine for his own benefit and use.
178. If any person shall be sued for killing or selling said
swine, he may plead the general issue, and give the special
matter in evidence.
SCHOOLS.
179. There shall, on the first Tuesday of September in every
second year, be appointed one person in each election district of
Somerset county, by the judges of the Orphans' Court thereof,
to whom commissions shall be issued by said judges immediately
after the said appointment, to be denominated " The Board of
Commissioners of Public Schools of Somerset County."
180. The judges of the Orphans' Court, of Somerset county,
may remove any school commissioner so appointed, for incoffl-
petency, or failure to perform any of the duties required of him,
or whenever they are fully satisfied that the interest and pros-
perity of the schools require such removal.
181. The said board of commissioners of public schools shall
meet on the third Wednesday of June next ensuing their ap-
pointment, or within ten days thereafter, and organize as a
board by the election of a suitable person from their number to
be president, and by the election of a treasurer and a clerk, and
any other officers that may be deemed necessary, of persons
within the board or not of their own number, as the said board
may deem most advisable; and shall also have power to remove
the same whenever they shall deem it advisable for the interests
of the schools so to do; the said treasurer, clerk or other officers,
