824 SOMERSET COUNTY. [ART. 19.

ROADS.

151. The supervisors of roads in Somerset county shall, from
time to time, summon as many of the able free male inhabitants
in their several districts above the age of twenty-one and under
the age of fifty years, to work upon the public, roads, in their
several districts, and require them to assemble at such place
within their districts as they shall appoint, with sufficient imple-
ments to work upon the roads.

152. The said supervisors may also hire carts and teams for
removing such stones, dirt, gravel and timber as may be neces-
sary for the repair of said roads.

153. They shall, within one month after receiving their com-
missions, make a list of all the able bodied free male inhabitants
above the age of twenty-one and under the age of fifty years
residing in their several districts, and of all the able bodied
male slaves above the age of sixteen and under the age of sixty
years residing therein, and they shall require the labor of the
said persons alternately, and in such convenient numbers and
classes as to place the burden of service equally upon all; but
the labor of said persons shall not be called forth during wheat
harvest, nor in such manner as to take more than half the
number of persons belonging to the same family at the same
time.

154. Whenever a supervisor shall think necessary to call upon
the inhabitants of his district to work; upon the roads, he shall
summon the number and class which he shall have previously
arranged, having regard to the quality and quantity of work
necessary to be done, and giving each free person liable to work
upon the same, and the master of each slave, at least two days'
notice of the time and place appointed for the labor, except in
such extraordinary cases as may require a shorter notice.

155. Every free person liable to work upon the roads so sum-
moned shall be liable to attend in person, or to provide a suffi-
cient substitute.

156. If any person, being summoned, shall neglect or refuse
to attend, or to find a substitute, he shall forfeit and pay the
sum of one dollar for each offence.
