818 SOMERSET COUNTY. [ART. 19.

120. The market house and grounds thereto attached in the
town of Princess Anne, are vested in the commissioners of Prin-
cess Anne.

121. The said commissioners shall annually appoint a clerk of
the market, and if the person so appointed shall die, resign or
refuse to act, or be removed from office, they shall appoint a
person to fill the vacancy for the remainder of the year.

122. The person so appointed, before entering upon the duties
of his office, shall make oath before the said commissioners that
he will diligently and faithfully, according to the best of his skill
and judgment, execute the duties of clerk of the said market
without favor, affection or partiality, and that he will not, directly
or indirectly, demand or receive any fee or reward for performing
such duties but what is allowed by law; and the said oath shall
be entered among the proceedings of the commissioners.

123. The clerk of the market shall have charge of the market
house and market, and may examine and inspect the victuals
and provisions brought thereto for sale; may examine and try
the weight of any butter brought to the market in prints or
parcels, and if found wanting in weight, shall seize and appro-
priate the same to the use of the poor house of Somerset county,
and if any be found unsound or unwholesome, shall destroy it;

shall try and adjust the scales, weights and measures used at the
market, by the standards of the county, and if any be found false
or untrue, shall seize and adjust the same and sell them at public
sale, and account to the commissioners for the proceeds.

124. If any person shall feel aggrieved by any seizure made by
the clerk of the market, he may appeal to the commissioners, or
any one of them, who shall make such order therein as they or
he shall deem just.

125. The clerk of the market may, under the direction of the
commissioners, rent out the stalls and shambles of the market
house, and shall keep an account of the persons renting and the
profits thereof, and render duplicates of said accounts to the com-
missioners annually on the first Monday of April, or oftener if
required, and the said rents shall be paid to the order of the com-
missioners, and in default of payment by any tenant, the said
rents, may be recovered in the name of the commissioners, as
other debts of like amount.
