offices by death, refusal to servo, removal out of the district, or
incapacity of any such officer, and'such vacancy shall not be
supplied by the district at a special or other district meeting
within one month thereafter, the commissioners of primary
schools shall fill such vacancy by the appointment of any person
residing in the district; and every person who shall be duly
chosen or appointed to any such office who shall refuse to serve
therein, shall forfeit and pay the sum of five dollars, to be re-
covered with costs of suit, by action of debt, in the name of the
commissioners of primary schools for Anne Arundel county,
before any justice of the peace of said county, and such sum,
when recovered, shall be paid to said commissioners for the use
of the primary schools in such district; and every person who
shall be duly chosen or appointed as aforesaid to serve in any
such office, and having accepted thereof, or who shall not declare
his refusal to accept, and shall neglect the performance of the
duties thereof, shall forfeit and pay the sum of ten dollars, to be
recovered with costs of suit in manner aforesaid and to the use
aforesaid.

161. The clerk of each school district shall keep the records
and proceedings of his district in a book to be provided for that
purpose; and whenever a special district meeting shall be called
by the trustees of the district, he shall give notice of the time
and place of said meeting at least ten days before the time of
holding the same; and when any district meeting shall be ad-

• journed for a longer time than one month, he shall give notice
thereof, in writing, at least ten days before the time appointed
by such adjournment, and so of every district meeting that may
be held.

162. He shall preserve all records, books, writings and papers
belonging to his office, and on the expiration of his time of service
shall deliver the same to his successor in office, in the same manner
as the clerk of the Circuit Court is required by law to deliver all
records, books and papers belonging to his office to his successor

• in office, under the penalty of his official bond.

163*. The commissioners of primary schools may appoint a
clerk, who shall receive such compensation for his services as the
said commissioners of primary schools may determine, to be
levied on the assessable property of the county, by the county
commissioners of said county.
