of the commissioners of the school fund, or in the name of any
other person, before any justice of the peace for said county,
and any person who shall accept either of said offices, or fail to
declare his refusal to accept, and shall neglect the performance
of The duties thereof, shall forfeit the sum of ten dollars, to be
recovered in the manner aforesaid.

138. Whenever any district meeting shall have voted a tax,
the trustees shall make a tax list which will raise the sum voted
for on all the taxable property of the district agreeably to the
assessment of the last preceding county tax, and annex to said
tax list a warrant in the following form, and deliver the same
to the collector of the district.

139. Queen Anne's county, ss. To ---, collector of the --
primary school district in Queen Anne's county, greeting: You
are hereby required and commanded to collect from each of the
inhabitants of said district the several sums of money written
opposite to the name of each of said inhabitants in the annexed
tax list,.and within sixty days after receiving this warrant, to
pay the'amount of the moneys by you collected into the hands
of the trustees of said district, or some one of them, and take
their or his receipt therefor; and if any one or more of said in-
•habitants shall neglect or refuse to pay the same, you are hereby
further commanded to levy on the goods and chattels of each
delinquent, and make sale thereof according to law. Given
under our hands and seals, this ---- day of ----. ----,
Trustees.

140. And if the sum or sums payable by any person named on
said tax list shall not be paid by him, or collected by virtue of
said warrant, within the time therein limited, the trustees shall
renew said warrant as to such delinquent.

141. It shall not be lawful to locate the site of any school
house within cultivated fields, orchards or gardens, nor within
a quarter of a mile of any dwelling, without the assent of the
proprietor.

142. The taxable inhabitants of a school district shall, in
locating a site for a school house, select a site as near the centre
of the district as practicable; and where school houses have
been built in any of the districts on sites of inconvenient dis-
tance to the scholars residing in the same, a majority of the
