number of children attending said schools regularly shall exceed
forty.

47. All moneys received by the county commissioners from
the treasury for the use of primary schools, shall be divided by
said commissioners annually, on the first day of January, equally
amongst the several school districts of said county which shall
have complied with the provisions of this article; and all moneys,
so divided, shall be paid by them to the trustees of the several
school districts in said county, whose receipts therefor shall be
good and sufficient evidence of such payments.

48. The taxable inhabitants of every school district in the
county shall meet annually, on the first Monday of May, at the
school houses in their respective districts, and elect three trus-
tees and a clerk for such district; the said meetings shall be
called to order at nine o'clock in the morning, or as soon there-
after as the taxables shall assemble; the trustees and clerks
shall be elected by ballot; the balloting shall be continued until
twelve o'clock in the day, and the persons receiving the highest
number of votes shall be declared duly elected, and the clerk
of the district, as soon as conveniently may be thereafter, shall
transmit to the county commissioners a copy of the proceedings
of such meetings.

49. If, from any cause whatever, a meeting shall not be held
in any district on the said first Monday of May, the clerk of said
district shall call a district meeting by giving ten days' notice
thereof, by advertisement set up at the most public places in
such district.

50. The trustees in any district may, in their discretion, call a
district meeting, notice thereof being given as directed in the
preceding section, and no district meeting shall be deemed illegal
for defect or want of due notice, unless the omission be wilful or
designed.

51. The clerk and trustees in each school district shall hold
their offices until the annual meeting of such district next fol-
lowing the time of their election, and until a new election shall
have been made; and in case of a vacancy in any of said offices
by death, refusal to serve, removal out of the district, or inca-
pacity of any such officer, and such vacancy shall not be supplied
by the district at a special or other district meeting within on;
