60. The person appointed clerk of the market; shall, before he
acts as such, take an oath before the said commissioners, or one
of them, that he will diligently and faithfully, according to the
best of his skill and judgment, perform the several duties of clerk
of the said market without favor, affection or partiality, and that
he will not, directly or indirectly, demand or receive any fee or
reward for performing said duties not allowed by law; and the
fact of said oath being taken shall be entered among the pro-
ceedings of the commissioners.
61. The clerk of the market shall take charge of the market
house and the market, and shall examine and inspect the victuals
and provisions brought thereto for sale; shall examine and try
the weight of any butter in prints or parcels brought thereto for
sale, and if the same be found wanting in weight, shall seize and
appropriate the same to the use of any prisoners who may then
be in the county jail, and if there be no such prisoners, to the
use of the alms-house of Dorchester county, and if any shall
be found unsound or unwholesome, shall seize and destroy the
same.
62. He shall try and adjust the scales, weights and measures
used at the market by the standards of the county, and seize and
sell to the highest bidder any found false or untrue, and account
for the proceeds to the commissioners.
63. If any person shall feel aggrieved by any seizure made by
the clerk of the market, he may, within three days, appeal to
the commissioners, or any one of them, who may make such
order therein as they or he may deem just.
64. The clerk of the market may, under the direction of the
commissioners, rent the stalls and shambles of the market house,
and shall keep an account of the persons renting and the profits
arising from such rents, and shall render duplicates of such ac-
counts to the said commissioners annually on the first Monday
of April, or oftener if required, and the said rents and profits
shall be paid to the order of the said commissioners, to be applied
to the repair and support of the market house.
65. The rent of the said stalls and shambles may be recovered
in the name of the said commissioners before a justice of the peace
as small debts are recovered.
