458 CECIL COUNTY. [ART. 6.

139. The clerk of the Circuit Court for said county, upon ap-
plication for license for the purpose mentioned in the preceding
section, and upon payment of forty dollars, shall issue such
license, and such license shall be renewed annually.

140. Any person offending against the provisions of the 138th
section of this article, shall be subject to a fine of not less
than twenty nor more than fifty dollars, to be recovered as small
debts.

POUT DEPOSIT.

141. The citizens of the village of Port Deposit in Cecil county
are a body politic by the name of " The President and Commis-
sioners of the Village of Port Deposit," and as such may sue and
be sued, and do all other acts as natural persons; may purchase
and hold real, personal and mixed property, and dispose of the
same for the benefit of said village, and may have and use a
common seal, which may be broken and altered at pleasure.

142. All free white male inhabitants of the said village, above
twenty-one years of age, who shall have bona fide resided in
said village for the space of six months, and twelve months in
this State, next preceding the election, shall, on the last Monday
in February in each year, at such house as shall be designated
as the town hall by the president and commissioners, elect five
judicious and discreet persons who shall have resided within the
limits of the said village for at least twelve months preceding
the election, as commissioners for said village.

143. All such elections shall be held and conducted as shall
from time to time be directed by the by-laws of the corporation,
not inconsistent with the provisions of this article.

144. If any of said commissioners during the year for which
he may be elected shall die, resign, remove from said village, or
be otherwise disqualified, an election to fill said vacancy shall be
held, at which all the persons qualified to vote as hereinbefore
mentioned shall be entitled to vote.

145. If the inhabitants of said village shall at any time neglect
to make an election at the time herein mentioned, the power
of electing commissioners shall not cease, but the right and
power of said inhabitants in that respect shall continue, and
