persons to whom payments have been made, the sums paid, and
the character of the work done.

140. The penalties and forfeitures which may be incurred
under the provisions of this article, in relation to the national
road, except where otherwise provided, may be sued for and
recovered in the name of " The Superintendent of that part of
the United States' road within the limits of the State of Mary-
land," without naming him as an individual, or of any person
prosecuting the same, before any justice of the peace for Alle-
gany county, as other small debts, the one-half to the State and
the other half to the informer.

141. If any superintendent shall die, resign, or refuse to act,
or remove from Allegany county, the Governor shall fill the
vacancy.

SCHOOLS.

142*. It shall be lawful for the Orphans' Court of Allegany
county to appoint annually, on the first Tuesday in May, five
Commissioners of Public Schools, who shall collectively be en-
titled the Board of Commissioners of Public Schools of Allegany
County.

143*. The Orphans' Court of said county shall give notice to
said parties so appointed of their appointment, and each of the
school commissioners so appointed shall hold his office for the
term of one year, and until his successor shall be duly appointed
and qualified in manner aforesaid, and in case any vacancy shall
occur in the said Board of Commissioners, by death, resignation
or otherwise, the same shall be filled by the Orphans' Court at
their next succeeding meeting after such vacancy shall have
occurred, or as soon thereafter as practicable; and each of said
Commissioners of Public Schools, before he shall proceed to act
as such, shall take the oath of office prescribed by the Constitu-
tion of this State to be administered by the Register of Wills of
said county.

144*. The Board of Commissioners of Public Schools of Alle-
gany County, and their successors, are incorporated and con-
stituted a body politic and corporate by the name and style of
the Board of Commissioners of Public Schools of Allegany
County, and by that name shall have perpetual succession, and
shall be capable in law to sue and be sued, to plead and be im-
