elect and recommend accordingly; and the proceedings of said
regimental meeting shall be certified to the officer who called it,
'and by him shall be transmitted to the Governor, with an appli-
cation for the necessary commission.
749. If there be no field officer or commanding officer of the
regiment to call the requisite meeting for the election and
recommendation of regimental field officers, or upon their neg-
lect or refusal, then that duty and all the consequential
duties shall be performed by the commanding officer of the
brigade to which said regiment is attached, or upon his re-
fusal or neglect, by the major general of the first light division.
750. No company of infantry or riflemen shall continue to
exist with less than thirty, and no company of artillery or
cavalry with less than twenty members, officers included; and
if any company shall appear with a less number four successive
parades, or upon four successive company returns, to the com-
manding officer of the regiment, and if any company shall fail
to appear at two successive law parades, or if the commanding
officer of the company fail to make two successive returns to
the commanding officer of the regiment as herein required, the
said company shall thereupon be reported by the commanding
officer of the regiment to the adjutant general as disbanded, and
the commissions of the officers of said company shall be revoked
and annulled by the Governor.
751. If any officer of said division shall be absent from four
successive parades, or shall fail to make four successive returns
to his commanding officer, assigned by law, he shall be reported
by his commanding officer to the adjutant general for such delin-
quency, and if no excuse is made satisfactory to the Governor,
he shall revoke and annul his commission.
752. Whenever two or more company officers of the same
rank, in the same regiment, have commissions of the same date, *
the commanding officer of the regiment shall determine by lot
the seniority of their officers; and the commanding officers of
the first and second light brigades shall, in like manner, in like
cases, determine the seniority of their respective regimental
field officers; and the major general commanding the first light
division shall, in like manner, in like case, determine the seniority
of the brigadier general attached to his division.
