shall be fined a sum not exceeding twenty dollars, in the dis-
cretion of such court martial as the case may require.

744. The first light division of Maryland volunteers shall be
composed as follows: the first brigade of the fifth regiment of
volunteer infantry, of the first cavalry regiment, and of the first
light artillery regiment of Baltimore volunteers; the second
brigade in said division shall consist of the first regiment of
riflemen and the fifty-third regiment of volunteer infantry.

745. No volunteer corps shall be allowed in said city except
those attached to said division.

746. No regiment in said division shall retain or receive any
company which is not of the same arm with itself, nor shall any
company leaving a regiment be received by another regiment of
the same arm without the consent in writing of a majority of
the field officers of the regiment that is left.

747. All officers to be appointed in said division shall in every
instance be recommended to the Governor for commissions in
the following manner, to wit: All company officers shall be
recommended by the members of their company, at a meeting
called for the purpose by the commanding officer of the regiment,
by advertisement published for at least three days previous
thereto in at least three of the daily newspapers published in
the city of Baltimore; and if there be no field or other com-
manding officer of the regiment to call such meeting, or upon
their neglect or refusal, that duty and all the consequential duties
shall be performed by the commanding officer of the brigade to
which said regiment and company are attached; and if there be
no brigadier general, or if the brigadier general shall neglect or
refuse to act, then all said duties shall be performed by the
major general of the first light division.

748. All regimental field officers in said division shall be elected
and recommended for commissions in like manner as the com-
pany officers, and the commanding officer of the regiment shall
give three days' notice in at least three of the daily newspapers
published in said city, of the time and place of meeting of all
the commissioned and non-commissioned officers and privates
belonging to said regiment, for the purpose of choosing a regi-
mental field officer to fill any vacancy or vacancies, and said
meetings, or a majority of those present, voting by ballot, shall
