244 CITY OF BALTIMORE. [ART. 4.

OYSTERS.

494*. All oysters carried to the city of Baltimore for sale, shall
be sold by the sealed half bushel, and measured on board the boat
carrying the same; and each and every person offending against
the provisions of this section shall be subject to a fine of fifty
dollars for each and every offence, to be recovered before a justice
of the peace of the city of Baltimore by action of debt in the
name of the State of Maryland, one-half to the informer and the
other half to the use of the State.

TOBACCO.

495*. There shall be elected, by the joint ballot of the Senate
and House of Delegates, three persons to be styled Tobacco
Commissioners, and who shall hold their offices for two years
and until their successors shall be elected and qualified.

496*, The persons so elected shall be chosen from Charles, Mont-
gomery, Prince George's, St. Mary's, Calvert, Howard, Oarroll,
and Anne Arundel counties, shall qualify by taking the oath of
office prescribed by the Constitution, before the clerk of the Su-
perior Court of Baltimore city, and shall receive an annual salary
of five hundred dollars each, to be paid Bemi-annually by the
Treasurer, on the warrant of the Comptroller, out of the tobacco
fund.

497*. The duties of the tobacco commissioners shall be as
follows: they shall on the first Monday of May in each year,
after three weeks' public notice thereof by advertisement in two
of the daily newspapers published in the city of Baltimore, who
will publish the same for a reasonable compensation, lease for
the term of two years from the said first day of May, at public
auction, to the highest bidder, each of the tobacco warehouses in
the city of Baltimore belonging to this State, together with all
the machinery, fixtures and materials therein of every descrip-
tion (except tobacco) belonging to this State; Provided, that
the said highest bidder be a bona fide citizen and resident
of this State, and a fit and proper person, in the opinion of the
said commissioners, to be a lessee of said warehouses; and if such
bidder be not a bona fide citizen and resident of this State and a
fit person, in the opinion of the said commissioners, to rent said
warehouses, then the said commissioners shall reject his bid, and
