meetings of slaves, negroes, and other dissolute and disorderly
persons within said city, and disperse them when assembled, by
lawful means, and shall punish with moderate correction, under
such regulations as shall be prescribed by the mayor and coun-
cilmen, all such negro slaves as shall be found strolling about
the streets at night, or frequenting the houses of other persons
without the consent of their masters or overseers.
51. The said bailiff shall have the same power and receive the
same fees as constables in Allegany county, for making arrests
or serving any process for violation of the ordinances of the
city, or in the discharge of his duty as bailiff.
52. All fines, penalties and forfeitures imposed by this charter,
or any ordinance of said city, may be recovered in the name of
the city, before the mayor or any justice of the peace as small
debts, and shall be paid to the mayor and councilmen for the
use of the city.
53. The mayor and councilmen of the city of Cumberland
may remove all nuisances and obstructions, and pass all ne-
cessary ordinances to remove all houses, fences, wagons and
stones from the public grounds and lots on which the court
house and prison in Allegany county are erected; and no person
shall build upon or fence in said public grounds, or any part
thereof; and any person who shall do so, and shall not remove
the same after ten days' notice by the bailiff of said city, shall
be fined not less than five dollars for the first offence, and ten
dollars for each week the same shall remain on said lots.
54. The mayor and councilmen of said city shall have the
same power over the said public grounds as over other parts of
said city, and may pass any ordinances relating thereto that
they can pass relating to the property of the city; but nothing
in this or the preceding section shall interfere with the title of
the county commissioners to said lots, or their control over the
same.
55. No person shall drive any carriage, wagon, or vehicle of
any description, or ride any horse upon or over the paved foot-
ways of the said city, under the penalty of two dollars for every
offence, and any constable or the bailiff of said city shall arrest
any person so offending and take him before a justice of the
peace, who, upon proof of the offence, shall give judgment in
