22. ALLEGANY COUNTY. [ART. 1,

the name of the State against the offender, upon which there
shall be no supersedeas, and the fine and costs shall be collected
and paid to the mayor and councilmen.

56. Any justice of the peace, upon proof that any offence has
been committed against the provisions of the preceding section,
shall issue his warrant against the offender, returnable before
himself or some other justice of the peace of said county, to be
dealt'with as directed in the preceding section.

DEES.

57. It shall not be lawful for any person to kill or destroy, or
try to kill and destroy, by running with dogs or otherwise, any
wild deer in Allegany county, except in the months of August,
September, October, November and December, under the penalty
of fifteen dollars.

58. Any person offending against the provisions of the afore-
going section, shall be liable to be proceeded against before a
justice of the peace of the county, in the name of the State, as
in. cases of small debts; and one-half of the fine shall go to the,
informer and the other half to the commissioners of the county,
to be added to the free school fund, and be distributed amongst
the several election districts, at the discretion of the county
commissioners.

59. Any person in whose hands or custody any deer flesh or
skins shall be found, that shall not appear to have been killed
within said months, shall be pri'ma fade deemed and adjudged
the killer or destroyer of such deer, and liable to the aforegoing
penalty.

60. Any master who shall willingly suffer any servant or slaves
under his care and management, to hunt or kill any deer, except
during the time aforesaid, shall be liable to said fine.

61. Any servant or slave who shall hunt or kill any deer
except during the months aforesaid, shall, on conviction thereof;

be whipped at the discretion of a justice of the peace, not ex-
ceeding thirty-nine lashes.
