limits of any incorporated town in Allegany county, unless he
shall first pay to the clerk of the Circuit Court for said county the
sum of fifty dollars for the privilege of so doing for one year, or
eight dollars per day for each day he may be so employed in selling.

4. The provisions of the preceding section shall apply only to
persons who shall bring goods, wares and merchandise from
abroad, to sell at auction within the limits therein mentioned,
and to persons who shall sell at auction goods, wares, or mer-
chandise sent from abroad, for the express purpose of selling
upon commission.

5. Any such person who shall sell goods, wares, or merchan-
dise at auction, within the limits aforesaid, without having first
paid the license in section three of this article required, shall be
liable to a penalty of twenty-five dollars, to be recovered by suit
in the name of the State, in the same manner as small debts are
recoverable.

6. The sheriff and constables of said county shall sue for and
collect said penalties and pay them to the clerk of the Circuit
Court for said county, and shall take duplicate receipts from said
clerk, and transmit one of said receipts to the Comptroller.

7. The clerk of the Circuit Court shall pay to the Treasurer
all money received for such licenses in the same manner and time
as the money received for other licenses, and shall be entitled to
the 'same commissions thereon, and the official bond of such clerk
shall be liable therefor.

BTJLLET PLAYING.

8. Any person who shall be found playing at bullets in the
public streets .of any town in •Allegany county, or any of the
public roads therein, shall be liable to be presented therefor in
the Circuit Court of the county, and upon conviction, shall be
fined in the dis'cretion of the Court, a sum not exceeding fifty
dollars.

CIRCUIT COURT.

9. There shall be three regular common law terms of the Cir-
cuit Court for Allegany county, commencing at Cumberland on
the first Monday in January, second Monday in April, and the
second Monday in October, in each year.
