138. All fints and forfeitures accruing under the preceding
sections of this article, relating to nuisances, may be recovered
before any justice of the peace for Baltimore county, one-half for
the use of tie said county, and the other for the use of the in-
former; and it shall be the duty of such justice respectively to
receive one-half of all such fines and forfeitures, and to render an
account thereof to the county commissioners of said county an-
nually at their October term, and to pay the amount to the
trustees of the poor for Baltimore city and county.

OBPHANS' COURT.

139. The sessions of the Orphans' Court for Baltimore county
shall be held on the Tuesday of each week from ten o'clock A. M.
till three o'clock p. M., and may be continued on the Wednesday
of each week, if, in the judgment of the court, the public business
and convenience require it.

140. The said court may sit during the sessions of the Circuit
Court for said county as frequently, and as long as it may deem
proper and necessary.

141. The judges of said court may appoint a bailiff, who shall
attend each sitting of the court, and perform such duties as the
court and register of wills may direct, and shall be paid quarterly
by the county commissioners, upon the certificate of the register
of wills, two dollars per day for each day he shall be in attend-
ance upon said court.

142. Each judge of said court shall be paid by the county com-
missioners of said county, upon the certificate of the register of
wills, three dollars per day for each day they may be in session,
and five cents per mile for going to and returning from each
session of said court over and above ten miles of the distance
from his place of residence to the place of holding the court; but
mileage shall not be allowed more than once for a protracted
session of two or more consecutive days.

143. The county commissioners of said county shall levy
annually such sum as they may estimate will be sufficient to
pay the judges and bailiffs of the Orphans' Court for the next
succeeding year; and it shall be the duty of the register of wills
to certify quarterly to the treasurer of the county the number
