WASHINGTON, February 20, 1868.

His Excellency, Thomas Swann,

Governor of the State of Maryland :

SIR—In obedience to an order of the Senate directing me
to inform you of its action in reference to the Honorable
Philip F. Thomas, claiming a seat in the Senate of the
United States, as a Senator from the State of Maryland, I
have the honor to transmit herewith its resolution passed on
the 19th of February instant.

I have the honor to be, sir,

IN THE SENATE OF THE UNITED STATES,

February 19, 1868.

Resolved, That Philip F. Thomas having voluntarily
given aid, countenance and encouragement to persons en-
gaged in armed hostility to the United States, is not entitled
to take the oath of office as a Senator of the United States
from the State of Maryland, or to hold a seat in this body as
such Senator, and that the President pro tempore of the
Senate inform the Governor of the State of Maryland of the
action of the Senate in the premises.

BY THE HOUSE OF DELEGATES.

February 21, 1868.

Gentlemen of the Senate :

We propose, with the concurrence of your Honorable Body,
the appointment of a joint committee, consisting of three
members on the part of this House and two on the part of
the Senate, to take into consideration the message of the
Executive, and accompanying papers, relative to the election
of the Honorable Philip Francis Thomas to the Senate of the
United States, and have appointed on the part of the House,
Messrs. Syester, Stewart. of Dorchester, and Blake.
