and Mercersburg road, unless in their opinion the
best interests of the road require either an entire
or partial change of route.

Sec. 9. And be it enacted, That in case the said
Board of Directors shall not be able to agree with
the owner or owners of any land over or through
which lands the said road may be made, it shall
be lawful for said Company to cause any Justice of
the Peace of Washington County to issue his war-
rant to the Sheriff of said county, directing him to
summon twenty' impartial jurors to meet on said
land on a day to be therein named, to assess the
damages sustained by said owner or owners by
reason of said road passing through such land,
which inquisition shall be returned to the Clerk's
office, and either party shall have the right to ap-
peal to the Circuit Court of said county from the
verdict or finding of said jury within sixty days of
the date of said verdict.

Sec. 10. And be it enacted, That said Company
shall cause said road to be completed within five
years from the passage of this Act.

Sec. 11. And be it enacted, That the width of
said road shall not be less than thirty-three feet
with a graded bed upon the same of not less than
seventeen feet in width, ten feet of which to be
covered not less than ten inches in depth with
stone not more than three inches in any diameter.

Sec. 12. And be it enacted, That the said Com-
pany shall have the right to erect two toll gates,
and they are hereby authorized to appoint toll
gatherers, whose duty it shall be to receive of and
from all and every person or persons using said
road the tolls and rates hereinafter mentioned, and
stop any person riding, leading or driving any
horse, cattle, sheep, hogs, wagon, cart, carriage,
sleigh, coach or any other carriage of pleasure or
burthen from passing through said gate until they
have respectively paid the same, in no case to be
more than the following, that is to say, for every
score of sheep or hogs five cent, for every score of
cattle ten cents, for every horse three cents, for all
carriages with one horse five cents, two horses ten
cents, four horses twenty cents, six horses thirty
