rated in the State of Maryland, for the purpose of
constructing a railroad in said State, to unite with
the railroad provided for in this Act, so that the
capital stock of the said Companies respectively
shall constitute one Company, and be entitled to
all the rights, privileges and immunities which
each of them possess ; have and enjoy, under and
by virtue of their respective charters, or this Com-
pany may contract with such Company or Com-
panies, on any other terms for the conveyance and
transportation of passengers or freight, or with any
individual for passengers or freight, or any individ-
ual whatsoever ; provided, that such contract be
not prohibited by the laws of Maryland.

Sec. 21. And be it enacted, That a copy of said
agreement of union to be formed shall within four
months from the date thereof, authenticated by the
seals of the corporations, and the signatures of
their respective President, be deposited and recorded
among the land records of Wicomico County.

Injure and
destroy.
|
Sec. 22. And be it enacted, That if any person
or persons shall willfully, by any means whatso-
ever, injure, impair or destroy any part of any
railroad constructed by said Company, under this
Act, or any of the necessary works, buildings, car-
riages, vehicles or machinery pf said Company,
such person or persons so offending shall each of
them, for every such offence, forfeit and pay to
said Company the actual damages sustained, which
maybe recovered in the name of said Company by
an action of debt, before any Justice of the Peace,
or in the Circuit Court of the county in which said
damages shall be sustained, and also be subject to
an indictment in the Circuit Court for the county
where such offences may be committed, and upon
conviction of such offence shall be punished by fine
and imprisonment, at the discretion of the Court.

Sec. 23. And be it enacted, That the said Com-
pany shall have the right to construct a line or
lines of wire or telegraph on any routes over which
by their charter they have the right to construct a
railroad, apd for that purpose shall be entitled to
the benefits of all the provisions contained in the
twenty-sixth Article of the Code of Public Gen-
eral Laws, from Section one hundred and two to
Section one hundred and twenty-one, inclusive, or
