road Company by virtue of its charter, to enter
upon and acquire title to any land, earth, materials
or improvements on the margin or borders of the
said creek which may be, needed and selected by
the said Company for its road, depot and wharf,
or with the right of the said Company to the exclu-
sive control, management and regulation of the
said road, depot and wharf when the same shall
have been constructed.

Sec. 18. And be it enacted, That this Act shall
take effect from its passage.

CHAPTER 144.
AN ACT to secure the completion of the Worces-
ter Railroad.
|

Lien by State,
|
SECTION 1 . Be it enacted by the General Assembly
of Maryland, That the lien held by the State of
Maryland, or which by law may be held on the
property of the Worcester Railroad Company, to
secure the payment of six per centum interest out
of the profits of the work, on the shares of the
capital stock of said Company, held, or which may
be held by the said State, shall not be construed to
give a preference to the said State over the bond-
holders of the said Company, and the said lien is
hereby expressly waived, postponed .and deferred
in favor of the holders of bonds of the said Com-
pany, which may be issued for the construction
and equipment of the said railroad, to an amount
not exceeding in the whole two hundred thousand
dollars.

take effect from the date of its passage.
