Sec. 2. And be it enacted, That the said Cum-
berland and Pennsylvania Railroad Company shall
and they are hereby required to furnish cars, ve-
hicles and transportation to each and every incor-
porated company, individual or association, being
the owner or lessee of any coal mine on or near
the Railroad or the branches thereof, owned and
worked by the said Cumberland and Pennsylvania
Railroad Company, and connected therewith by
tracts or planes equal to, suitable for, and suffi-
cient in capacity to transport, over said Railroad
and branches thereof from such mine or mines to
the city of Cumberland, all the coals mined from
such mine or mines by any owner or lessee thereof
engaged in working the same. And in default or

failure on the part of the said Cumberland and
Pennsylvania Railroad Company to furnish such
cars, vehicles and transportation to the owner or
lessee of any mine as aforesaid, sufficient for the
transportation of all the coal mined by said owner
or lessee as aforesaid ; then upon such neglect or
failure, the said Cumberland and Pennsylvania
Railroad Company shall on the demand of any
such owner or lessee forthwith apportion and dis-
tribute its coal cars, vehicles and transportation
equally and pro rate among each and every incor-
porated company, individual or association, being
the owner or lessee of any coal mine or mines,
then engaged in working the same connected with
said Railroad or of the branches thereof by tracts,
switches or planes.

Sec. 3. And be it enacted, That this Act shall
take effect from and after its passage.
