Senate bill entitled an Act to authorize the Baltimore and Ohio Rail Road Company to lay a railroad tract in certain streets in the city of Baltimore, and to make an appropria- tion for paying the expenses thereof, on account of and for the interest of the Tobacco fund, Was read the second time and ordered to be engrossed for a third reading. Mr. Maddox from a Select Committee Reported Senate bill entitled an Act to provide for THE erection of a new Maryland Penitentiary, and to dispose of the present Maryland State Penitentiary, Which was read a first time. House bill entitled an Act to authorize the location of a public road in Frederick and Carroll counties, Was taken up on its third reading. Mr. Biggs offered the following amendment, Section 1, line 9, strike out " Ellis " and insert " Gillis." Which was adopted. The bill was then read a third time, and passed by yeas and nays, as follows : AFFIRMATIVE. Messrs. President, Henkle, Browne, Hyland, Biggs, Malone, Brewer, Spates, Clarke, Smith, Denson, Walsh Earle, Welch—14. NEGATIVE—None. And returned to the House of Delegates.
