That in the debates leading to this resolution, it is appa-
rent that the gravemen of the high crime charged against
the Senator from Maryland, is limited to an act of kindness
and provision, for his own child—an act solely pertaining to
his domestic and private life, the motive for which cannot de-
cently, and ought not to be inquired of or judged at large,
and which it was as undignified as it is pernicious to expose
to public comment.

That in these transcendant violations of the compact of
government by the Senate of the United States, there was no
question before that body of a violation of the "rules of its
proceedings" of the punishment of a member for" disorderly
behavior" or of "expulsion," nor any question of "impeach-
ment of a civil officer," but a high-handed usurpation of
prerogative, to judge of qualifications not enumerated in the
Constitution, and not delegated to it to judge of, there was
the erection of a standard of qualifications to which no limit
can be assigned, but ever subject to the prejudices and indi-
vidual conscience of Senators.

Resolved by the General assembly of Maryland, That in
consequence of these unlawful encroachments, and the dan-
gerous precedent they afford, and to maintain the dignity
and just rights of this State, they do hereby solemnly pro-
test, for themselves and their posterity, against the action.
of the Senate of the United States, and record these their-
reasons for this protest.
