or prize in any lottery, or other device or game of chance; or of
any certificate, writing or token, that any person shall be, or
may become entitled to any prize or interest whatsoever, that
shall be depended on the drawing or determination of any
lottery, or other device or game of chance, granted by this slate,
and approved of by the lottery commissioners, or proposed by
the said commissioners, on behalf of this state ; or to open, set
up, use, or keep by himself, herself or themselves, or by any
other person or persons, any office, house or other place, for
selling, vending, bartering, assuring, furnishing, giving, procur-
ing, supplying, notifying or registering, any ticket, share or
interest in any ticket, or prize, in any lottery, or other device or
game of chance, or any certificate, writing, or token, that any
person shall be or become entitled to any prize, or interest
whatsoever, that shall be dependent on the drawing or determi-
nation of any lottery or other device or game of chance, granted
by this state, and approved of by the lottery commissioners, or
proposed by the said commissioners on behalf of this state,
unless such person or persons shall have first obtained, and be
entitled to use, a license to vend lottery tickets in the manner
herein after prescribed; and any person offending in the pre-
mises shall be deemed guilty of a misdemeanor, and on convic-
tion thereof, shall be subject to a fine not exceeding fifty dollars
for each and every ticket or share in any ticket, or prize, in any
lottery or other device, or game of chance, or each and every
certificate, writing or token, that any person or persons shall be
or may become entitled to any prize, or interest whatsoever, that
shall be dependent on the drawing or determination of any
lottery or other device or game of chance, so vended, sold, bar-
tered, assured, furnished, given, procured, supplied, notified or
registered ; and to a fine not exceeding two hundred dollars for
each and every day or part of a day, that such office, house, or
other place, shall be so opened, set up, used or kept, or to im-
prisonment not exceeding six months for any and every such
offence.

be granted,
&c.

SEC. 7, And be it enacted, That a license to sell, vend, barter,
furnish, procure, notify and register, tickets in the lotteries
granted by this state, and which shall be approved of by the
lottery commissioners, or be proposed by the said commissioners
on behalf of this state, shall be issued to any person or persons
applying for the same, who at the time of making such applica-
tion, shall pay therefor to the clerk of the city court of Balti-
more, if to be used in the said city, or within five miles thereof,
at the rate of two hundred dollars per annum, to the use of the
state, or if elsewhere to be employed, then to the clerk of the
county in which the same is to be used, at the rate of fifty
dollars per annum, to the use of the state, which said license
