CHAPTER 156.
AN ACT to authorize the Orphans Courts in this State to appoint Trustees
in cases therein mentioned.

 

SEC, 1. Be it enacted, by the General Assembly of Maryland,
That in all cases where special acts of assembly have been
passed, authorizing any orphans court in this state to appoint a
trustee to sell and dispose of real estate the property of minors,
and the trustee appointed hath died or removed without com-
pleting and fully executing his trust, the orphans court of the
proper county shall be, and is hereby authorized and empow-
ered to appoint another trustee to carry into effect the provisions
of the particular act.

SEC. 2. And be it enacted, That the course of proceedings
shall be regulated in each case in which proceedings may be
had under this act, according to the provisions of the particular
act under which a trustee has been appointed, and who has died
or removed without fully executing and completing his trust.

CHAPTER 162.

Course of
proceeding.

A SUPPLEMENT to the ACT,* entitled, an Act incorporating into one the
several acts relating to Constables' Fees.

Be it enacted, by the General Assembly of Maryland, That
in all cases where a fieri facias or execution is levied or served
by any constable for debt, that such constable shall be entitled
to receive for the same, seven and a half per cent, for his
poundage fee on the first twenty-six dollars and sixty-six and
two-third cents, and three per cent, for his poundage fee on the
residue, to be charged and recovered in the same manner as the
sheriffs of this state are authorized to.charge and recover simi-
lar fees ; and that in all cases where a constable levies a distress
for rent, the tenant shall be liable to the landlord for costs, any
thing contained in the original act to which this is a supple*
ment, or in any other law, to the contrary, notwithstanding ;

Provided, That if the defendant shall supersede the judgment
on which the said fieri facias or execution shall have issued
within four days after the same shall be levied or served, that
then the constable shall be entitled to receive only one-third of
said poundage fees.

CHAPTER 175.

Proviso.

A SUPPLEMENT to the ACT*, entitled, an Act relating to Constables1 Bonds.
See 1835, ch. 201 ; the penalty of their bond increased.

Be it enacted, by the General Assembly of Maryland, That
from and after the passage of this act, it shall be the duty of the
levy courts of the several counties of this state, before they
