CHARLES COUNTY.

SEC. 8. And be it enacted, That the commissioners elected
or appointed as aforesaid, and their successors, shall be and
they are hereby constituted a body politic and corporate by
the name, style and title of the commissioners of Charles
county, and by that name shall have continued succession,
and be capable in law of suing and being sued, of making and
using a corporate seal, of doing all such aets as shall be neces-
sary to the exercise of all powers, which are or shall be vested
in them by this act, or by any other act of assembly, as fully
and effectually as corporate bodies may or can lawfully and
rightfully do.

SEC. 9. And be if enacted, That when, and as soon as the
commissioners to be elected or appointed as aforesaid, shall
have taken and subscribed the oath or affirmation herein before
described, all the powers, rights and privileges, lawfully ex-
ercised by, and all property, estate and effects vested in the
justices of the levy court of Charles county, shall be trans-
ferred to, and vested in the commissioners for Charles county,
who, or a majority of them, shall hereafter exercise all the
said powers, rights and privileges, and shall perform all the
duties required to be performed by the said justices of the
levy court of Charles county, and no appointment of justices
of the levy court of Charles county shall thereafter be made.

SEC. 10. And be it enacted, That it shall be the duty of
the said commissioners annually to appoint a clerk, and in case
of vacancy from any cause, to supply said vacancy at their first
meeting thereafter, or as soon as practicable, whose duty it
shall be to transact all the business and discharge all the
duties now appertaining to the clerk of the levy court for
said county, in the same manner as the clerk of the levy court
of said county is now authorized and required to transact the
same, and the person so appointed shall, before he enters upon
the duties of his office, execute a bond to the state of Mary-
land, to be approved by the said commissioners, in the penal
sum of one thousand dollars, conditioned for the true and faith-
ful performance of the several and respective duties imposed
upon him by law ; which bond shall be recorded in the office
of the clerk of said county, and a copy thereof, under the seal
of said court, shall be as sufficient evidence as the original ;
and the said clerk, when appointed, shall also take an oath
or affirmation, that as clerk to the commissioners of Charles
county, he will diligently and faithfully, without partiality or
prejudice, execute and discharge the duties of said office to
the best of his skill and judgment ; which oath or affirmation
any one of the said commissioners is hereby authorized to
administer.
