ROADS.

ROADS.
AN ACT to straighten and amend the several Public Roads in several
Counties, and for other purposes therein mentioned. — 1790, ch. 32.

WHEREAS, some of the principal market and post-roads in
the counties of Cecil, Baltimore, Montgomery, Frederick and
Washington, are very indirect, much out of repair, and require
considerable improvements,
SEC. 2, 3. Authorize the location and opening of certain public roads.

Preamble.

SEC. 4. And be it enacted, That the justices of the said se-
veral counties of Cecil, Montgomery, Frederick and Washing-
ton, in their respective courts sitting, (except Baltimore county
court,) to be held next after the first day of March next, and
thereafter in the last court of the year annually, shall levy a
sum of money not exceeding the sum of three shillings and
nine-pence current money on every hundred pounds worth of
assessable property in each of the said counties, except in
Montgomery county, and the justices of Montgomery county
shall levy a sum of money not exceeding two shillings current
money on every hundred pounds worth of assessable property
in said county, to be collected in the same manner, at the same
times, and by the same persons, as other county taxes are
collected, and shall be paid quarter-yearly into the hands of
supervisors, to be appointed in manner herein after mentioned ;
Provided, that no property in Frederick county subject to be
taxed for the purpose of repairing the streets and alleys in
Fredericktown, shall be subject to be taxed under this law,
further than a sum which, being added to the tax aforesaid,
will amount in the whole to the sum of three shillings and
nine-pence current money.
The power of assessment is vested in the county commissioners.
SEC. 5. See note to second and third sections.
SEC. 6. As to filling up the Board of Commissioners to locate the roads.

SEC. 7. And be it enacted, That the monejrs to be levied in
virtue of this law in any of the aforesaid counties wherein
there are two or more roads, shall, upon a due estimate thereof
at the time of making the levy, be appropriated in equitable
proportions by the justices of the courts respectively to the
aforesaid several roads, and it shall be the duty of each and
every of the supervisors aforesaid, to apply the same accord-
ingly, and to render separate and distinct accounts upon oath,
of the expenses of each and every road, as vouchers to their
respective accounts current with the said counties.
SEC. 8. As to the mode of compensation for the land condemned for the
particular roads authorized to be located under this law.

SEC. 9. And be it enacted, That if any person or persons
shall presume to alter or change, or in any manner obstruct or
encroach on, any of the said roads, or on any part or parts
thereof, or to cut down or destroy, deface or injure, any of the
