said inhabitants, at a meeting held the twenty-first of Decem-
ber last, are invested with all the powers conferred by this
act, upon the trustees hereafter to be elected.

Penalty for
neglect to
serve as
trustee.

SEC. 3. And be it enacted, That if any trustee, after consent-
ing to serve, shall resign before his time expires, or neglect or
refuse to discharge the duties imposed upon him by this act,
shall forfeit the sum of twenty dollars, to be recovered in the
name of the collector of said district, or in the name of either
of the trustees, in an action of debt, before any justice of the
peace of said county, and applied to the use of the school of

said district ; and if the office of any trustee shall become va-
cant by the death of such trustee, or his removal out of the
district, or from any other cause, the remaining trustees, or
any three or the taxable inhabitants of said district may by a
written public notice, call a meeting of such inhabitants, a ma-
jority of which meeting shall elect another trustee to serve till
the next annual meeting.

Levy au-
thonzed.

SEC. 4. And be it enacted, That the trustees of said district,
shall have power to levy upon all the assessable property
of said district, except the property of coloured persons, the
sum of one hundred dollars, for repairing and fitting up the
school-house now belonging to said district; to levy annually
on said property, a sum not exceeding three hundred dollars

for the employment of a teacher ; to employ a teacher and fix
his salary ; to adopt regulations for the school, and to receive
from the commissioners of the school fund of Queen Anne's
county, such portion of that or any other fund, as may be
allowed to any other primary or free school in said county.

Collector;
duties, be.

SEC. 5. And be it enacted. That the said trustees in the
month of January every year, shall appoint a collector ; who
shall give bond in like manner, and whose duties and powers
shall be the same as those prescribed in the eleventh section
of the act passed at December session, eighteen hundred and
twenty-five, for the instruction of youth in primary schools,
and shall in the month of June, every year, place in his hands
a list of the persons owning or holding property in said dis-
trict, with the sums levied on each, together with a warrant
annexed thereto, requiring the said collector to collect from
such persons the sums aforesaid, before the first day of the fol-
lowing December ; and the said taxes shall be levied for the
amount required, according to the valuation made of such pro-
perty on the books of the levy court ; and it shall be the duty
of the clerk of said court, to furnish such trustees with a list
of such valuation or such other statement as they may require.

Accounts.

SEC. 6. And be it enacted, That the said trustees shall keep
an account of their proceedings, and report the same to the
taxable inhabitants of the district at their annual meetings, or
