Appoint- ment and duties of clerk.	SEC. 3. And be it enacted, That the levy court for Prince George's county shall, on the second Monday in March next, appoint a fit and proper person, who shall transact all the busi- ness, and discharge all the duties now appertaining to the seve- ral and respective offices of clerk of the levy court and commis- sioners of the tax, in the same manner as the clerk of Prince George's county court, and the clerk of the commissioners of the tax for said county, are now by law severally authorized and required to transact the same ; and the person so ap- pointed shall, before he enters upon the duties of his office,
Bond.	execute a bond to the state of Maryland, to be approved of by the said levy court, in the penalty of one thousand dollars, conditioned for the true and faithful performance of the several and respective duties hereby imposed, which bond shall be re- corded in the clerk's office of the county court of said county, and a copy thereof, under the seal of the court, shall be as suf- ficient evidence as the original ; and the clerk when appointed,
Oath.	shall take and subscribe the following oath, or affirmation, as the case may be, to wit: 1, A. B. do swear, or affirm, that as clerk to the levy court of Prince George's county, I will honestly and faithfully, to the best of my skill and judgment, execute the duties of said office, without favour, affection, or prejudice, so help me God ; which oath or affirmation, any one of the said levy court is hereby authorized to administer ; and
Penalties.	the said clerk shall be subject to the same penalties and for- feitures for non-performance or neglect of official duty, as are prescribed by the existing laws in relation as well to the seve- ral matters and things which the clerk of the county court of said county is legally directed and required to perform, under the authority of the levy court, as likewise to those which ap- pertain to the office of the present clerk of the commissioners of the aforesaid county.
Case of vacancy.	SEC. 4. And be it enacted, That in case of a vacancy occur- ring in the office of clerk to the levy court as created by this act, in consequence of death, resignation, removal or disquali- fication, the same shall be supplied as soon thereafter as may be practicable, in the manner prescribed by the preceding section of this act.
Compensa- tion.	SEC. 5. And be it enacted. That the said clerk to the levy court, to be appointed in virtue of this act as aforesaid, shall be entitled to receive as a compensation for his services, such sum annually, as the said levy court may direct, not exceed- ing three hundred dollars, to be levied on the assessable pro- perty of said county, collected and paid over as other county charges.
Demand and take	SEC. 6. And be it enacted, That upon the appointment of a clerk to the levy court as aforesaid, the clerk of Prince
