of a causeway, but it must in every instance be covered with
earth, and drains must also be cut with the plough, if practica-
ble, of sufficient depth to preserve the road from being in-
jured by the absorption of water collecting on the sides : he
shall examine each break-water of his district after every rain
calculated to do injury thereto, to ascertain if it answers the
purpose for which it was constructed, and whenever he finds
any defective, either from error in construction or from use, he
shall forthwith correct or repair the same, and in every in-
stance of neglect so to do, the injury resulting to the road shall
be repaired at his cost ; and at any time he is informed, or
otherwise ascertains, that a break-water has yielded, so that it
does not answer its purpose, he shall forthwith repair it, sub-
ject to the same penalty for neglect.

Their
allowance.

SEC. 4. And be it enacted, That the supervisors appointed
under this act shall be entitled to receive at the rate of two
dollars for each day they are employed in the execution of the
duties hereby prescribed.

Not to
work with
less than
six bands.

SEC. 5. And be it enacted, That no supervisor shall at any
time proceed to work and labour on the public roads of his
district without six able-bodied hands, unless it be for the pur-
pose of removing fallen trees, or other obstructions, or for re-
pairing or correcting defects which may take place in a break-
water, under the pain of forfeiting his own wages for the time
he shall work without six hands as aforesaid, which shall be
deducted from his allowance by the levy court.

Inspectors
to report to
grand jury.

SEC. 7. And be it enacted, That it shall be the duty of every
inspector of public roads, who shall have endorsed on a super-
visor's account that the roads are not in good repair, and that
the money has not been properly expended, to present the fact
to the grand jury, and if the grand jury shall find a bill against
the said supervisor, he shall be fined, at the discretion of the
court, not less than five nor more than thirty dollars.

Levy court
to meet
annually.

SEC. 8. And be it enacted, That the levy court of Mont-
gomery county shall meet annually on the second Monday in
October to settle the accounts of supervisors.

SEC. 9. And be it enacted, That if the levy court shall not
meet on the second Monday in October in any year, as is
hereby directed, that the clerk of Montgomery county shall
appoint a day, within twenty days of the second Monday of
October, for their meeting, to settle the accounts of the super-
visors, and give notice thereof by publication in any newspaper
published in said county.

Supervisor
to be fur-
nished with
a list of
roads.

SEC. 11. And be it enacted, That it shall be the duty of the
levy court to furnish each supervisor with a list of the public
roads of his district, designating to which district a road shall
belong which is a dividing line between districts.
