CONSTABLES.

SEC. 8. And be it enacted, That when and as soon as the
commissioners to be appointed by this act shall have taken and
subscribed the oath or affirmation herein before directed, all the
powers, rights and privileges lawfully exercised by, and all
property, estates and effects vested in the levy court of Mont-
gomery county, or in the commissioners of the tax for said
county shall be transferred to, and vested in the commissioners

the duties required by law to be performed by the levy court
of said county and the commissioners of tax, and no appoint-

missioners shall form a board for the transaction of business,
any two of whom may decide upon all matters coining before
them ; but the concurrence of three of said commissioners
shall be necessary in directing the payment of money, or in

tion of such business as may be brought before them, and shall
also have power to adjourn from time to time, and sit such
number of clays as may be necessary for the discharge of all the
duties required of them.

SEC. 11. And be it enacted, That all suits at law, or in equity,
which may be pending at the time of the passage of this act,
in which the levy court of Montgomery county are parties,
shall be carried on in like manner, and have the same effect
and operation in law as if the commissioners appointed by this
