Recorded.	administer, and said oath shall be recorded in the clerk's office of Montgomery county court, and the said clerk shall also be subjected to the same penalties and forfeitures for non-perfor- mance, or neglect of official duty, as are prescribed by the existing laws in relation to the respective offices of clerk of the levy court and commissioners of the tax.
Gate of vacancy of clerk.	SEC. 5. And be it enacted, That in case of a vacancy in the office of clerk to the commissioners, as created by this act, by death, resignation, removal or disqualification, the same shall be supplied by the said commissioners as soon thereafter as may be practicable.
His com- pensation $ 3 00.	SEC. 6. And be it enacted. That the said clerk shall receive three dollars for every day he shall attend the session of said commissioners, and such further compensation for official duties performed on other days as may be allowed by said commis-

Delivery over of books.	SEC. 7. And be it enacted, That upon the appointment of a clerk to the said commissioners, the clerk cf Montgomery county court, shall, on demand of the clerk to said commis- sioners, by order of said commissioners, forthwith deliver over to said clerk of the commissioners, all the books, accounts, papers and documents belonging, or in any manner appertain-
Make annual accounts.	ing to the levy court of said county, and shall annually, on or before the first Monday in April, furnish to and lay before the said commissioners, all such accounts, papers and documents, as may be necessary to the said commissioners, in ascertaining the county charges according to the directions which he may, from time to time, receive from said commissioners, and for
