SEC. 8. And be it enacted, That the said superintendants of
free schools, shall have power to admit pupils other than
those provided for in the fifth section of this law, into the said
schools on such terms and conditions, and the payment of such
tuition money as they shall think just. All moneys received
for the instruction of such pupils, to be paid by said superin-
tendants to the register of Frederick, and constitute a part of
the school fund created by this act.

SEC. 9. And be it enacted, That seven superintendants of
free schools, shall, at all meetings, be deemed a sufficient
number, to transact any business required to be performed by
said superintendants, under this act.

SEC. 10. And be it enacted. That all acts, or parts of acts of
assembly heretofore passed, inconsistent with or repugnant
to the provisions of this act, be, and the same are hereby
repealed.
SEC. 11. And be it enacted, That if the Rev'd John M'Elroy
shall annually in the month of March, report to the superin-
tendants of free schools for the city of Frederick, the number
of white minors, residents within the taxable limits of Fre-
derick, gratuitously educated at St. Johns benevolent school ;
it shall be the duty of said superintendants, to pay to the said
Rev'd John M'Elroy, a portion of the money raised for the
establishment of free schools, in Frederick, equal to the amount
paid for the education of the same number of charity pupils,
who may be educated at any other fiee school in Frederick,
and the said superintendants shall make a return to the regis-
ter of Frcderick, of the number of pupils in St. John's bene-
volent school, together with the amount of money paid for their
education, and make an estimate of the probable expenses,
which may be incurred therein, for the next ensuing year, in
the same manner and at the same time that is provided for their
report in reference to other free schools of Frederick ; Pro-
vided always, that in estimating the amount to be paid for the
use of St. John's benevolent school, the said superintendants
shall include the sum now paid annually, for the benefit of said
school, out of the school fund for Frederick county.
