FREDERICK COUNTY.

Stephen Steiner, Doct. Jacob Baer and Poet, John Baltzell,
together with all regular ministers of the gospel residing in
Frederick, be, and they are hereby constituted and appointed
superintendants of free schools for Frederick, with the powers
and duties herein after mentioned.
|
Organiza-
tion.
|
SEC. 3. And be it enacted, That the said superintendants of
free schools shall assemble on or before the first Monday of
April next, and on the same day annually thereafter, and elect
from their own body one president, and such other officers as
they may think necessary ; they shall proceed on or before the
second Monday of April next, to lay off Frederick into as

many school districts as they may deem requisite to carry the
intentions of this act into effect, and shall file with the register
of said town, a list of said school distiicts, with their numbers
and limits ; they shall within one month from the time such

school districts shall have been so laid off, give public notice in
the several newspapers of Frederick, that they will proceed on
a certain day to be therein mentioned, to appoint one teacher to
each school district, the salary to be allowed each teacher, shall
also be stated in said notice.

Duties and
powers of
superin-
tendants.
|
SEC. 4. And be it enacted, That said superintendants of
free schools, shall make all necessary rules and regulations for
the government of the schools, created by this act ; and shall
purchase books, stationery and fuel for the use of said schools,
provide school-houses, visit and examine into the condition of
said schools, at least once in every three months ; dismiss any
teacher for incompetency, improper conduct or other satisfac-
tory cause, and appoint a successor; pay the salaries of the
teachers, and all incidental expenses by orders on the register
of the town, signed by their president, and shall annually in
the month of April, report to the corporation of Frederick, the
number of pupils in such school ; the amount of money paid for
teachers and incidental expenses, and shall make an estimate of
the probable expenses which will be incurred in the next
ensuing year.

Vacancies.
|
SEC. 5. And be it enacted. That in case of the death, resig-
nation or refusal to serve, of any superintendant of free schools
herein appointed) or who may be hereafter appointed, the
aldermen and common council of Frederick, shall proceed to
fill the vacancy thereby occasioned, at their first meeting after
such vacancy shall have occurred.

Pupils.
|
SEC. 6. And be it enacted. That all such white minors, re-
siding within the taxable limits of Frederick, as may apply to
either of said superintendents of free schools, to be gratuitously
educated, shall be at liberty to become pupils in the schools of
their respective school districts, free of all charge whatsoever.

Sec. 7. And be it enacted. That, that portion of the school
fund of Frederick county, heretofore directed by act of assem-
