Penalty for
moneys
misapplied.
|
SEC. 4. And be it enacted, That if any of said commis-
sioners shall prove delinquent in any of the duties incumbent
on them, under the law relative to their trust, or shall in any
way misapply said moneys committed to their trust, they shall
be accountable to the orphans court aforesaid, in any action or
actions at law in any court of justice, to be brought by and in
the name of said orphans court, for the amount of moneys so
misapplied by them, or for damages, such as shall be deemed
by said court proper for such delinquency or misconduct.

Report to
legislature.

SEC. 5. And be it enacted. That the said orphans court shall
every year report to the legislature an accurate account of all
their proceedings under this act, at the commencement of each
session thereof, and also an account of the number of pupils
educated out of said fund, designating the age and sex.

Accounts to
be kept.
|
SEC. 6. And be it enacted, That the register of wills of
Charles county shall perform all such services as he may be
required and directed by the orphans court of said county to
perform in virtue of this act, without fee or reward ; and he
shall keep, in a well bound book or books to be provided for
the purpose, fair and correct accounts and statements of the
proceedings of the said court in relation to the proportion of
the school fund to which the said county is, or may hereafter
be entitled, exhibiting, in a particular manner, how the same
has or may be appropriated and disposed of; which said book
or books shall be kept open and accessible to the examination
and inspection of the citizens of the county, and all other per-
sons that may be interested or in any way concerned therein.

Vacancies
|
SEC. 7. And be it enacted, That from and after the passage
of this act, the orphans court of said county shall fill all vacan-
cies which may occur by death, resignation, or otherwise, in
the board of the commissioners of the school fund of said
county.

Repeal
|
SEC. 8. And be it enacted, That any law inconsistent with
the provisions of this act, be, and the same is hereby repealed.

SEC. 3. And be it enacted, That each of the commissioners,
for every day's attendance in virtue of this act, shall receive
two dollars ; Provided, the number of days shall not exceed
ten for any one commissioner, and the levy court of said county
are hereby authorized and required to levy the same on the
