COMMISSIONERS.

gates aforesaid, the number of votes given In their respective
districts for a member, or members, of the levy court, as the
case may require, and the judges of the several election dis-
tricts of said county, when met at the court-house of said
county, to ascertain and certify the election of delegates afore-
said, shall ascertain the number of votes given as aforesaid for
candidates for the levy court aforesaid, and by a certificate to
be filed in the office of the clerk of the county court of the
county aforesaid, and which shall be by said clerk recorded,
certify in form similar to the certificate of the election of dele-
gates, that the six persons by name, Who they shall ascertain,
received the greatest number of votes in said county, are duly
elected members of the levy court of Calvert county to serve
for the period of two years from the date of their said election,
and in the event of a tie between two or more persons, (he
same shall be decided by ballot at the first regular meeting of
said levy court.

 

SEC. 5. And be it enacted, That if any member of the said
levy court shall die, resign, refuse Or neglect to qualify within
twenty days, as member of the levy court aforesaid under this
act, or shall remove from the said county, at any time within
the period for which he shall have been elected, the residue of
the said membets of the levy court shall appoint a person as is
herein before provided in case of an original election, to fill hid
place until the next election for members of the levy court
aforesaid.

SEC. 6. And be it enacted, That the members of the levy
court so elected or appointed, shall, before they enter upon the
discharge of their duties, qualify in such manner and form as
the members of the commissioners' court qualify.

SEC. 7. And be it enacted, That when and as soon as the
members of the levy court herein appointed, or those here-
after to be elected, shall qualify as aforesaid, all the powers
rights and privileges lawfully exercised by, and all property,
estate and effects vested in the commissioners' court of Calvert
county, shall be transferred to, and vested in the levy court Of
said county, who, or any three of them, shall thereafter exer-
cise all the powers, rights and privileges, and shall perform
all the duties required to be performed by the said commis-
sioners' court of Calvert county.

SEC. 8- And be it enacted, That the members of the levy
court aforesaid, shall receive such salary or per diem, as mem-
bers of the commissioners' court receive.

SEC. 9. And be it enacted. That all suits at law or in equity,
which may be pending at the time of the passage of this act, '
by or against the commissionerd' court of said county, shall be
carried on in like manner, and have the same legal effect,
