Be it enacted, by the General Assembly of Maryland, That
|

the governor, by and with the advice and consent of the senate,
|

be authorized to fill the vacancy occasioned by the tie vote re-

ferred to in the above preamble;by appointing one of the two,
|
|
who were candidates at the late October election, in the same
|
|
manner as is provided for the filling vacancies in the act, to
|
|
which this is a supplement; and that in all cases hereafter,
|

where there shall be £ tie between two or more candidates for
|
cases.
|
the office of county commissioners in said county, the sheriff
|
|
of said county, as soon as such tie is ascertained to exist, shall
|
|
issue his proclamation commanding a new election in such dis-
|
|
trict, giving the usual notice required by law, which election
|
|
shall be held in all respects, according to the provisions of the
|
|
election laws of this state.
|
|
A SUPPLEMENT to an ACT, entitled, an Act to provide for electing Com-
|
|
missioners for Allegany County, and prescribing their powers and duties,
|
|
passed at December session, eighteen hundred and twenty-nine, chapter
|
|
twenty-five.— 1838, ch. 148.
|
|
Be it enacted, by the General Assembly of Maryland, That
|

the county commissioners of Allegany county, be, and they are
|
directed.
|
hereby directed to publish annually, in two newspapers pub-
|
|
lished in said county, an exhibit of the receipts and expendi-
|
|
tures of said county, naming the amount, and from what
|
|
sources received, the sum, or sums levied, the object, or work,
|
|
for which appropriations have or may be made, the amount ex-
|
|
pended on each, and the person receiving the same, any thing
|
|
in the act to which this is a supplement, to (he contrary not-
|
|
withstanding.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
|

That from and after the passage of this act, it shall be the duty

unrepresented by a resident commissioner, for the purpose of

electing one ^commissioner to fill such vacancy, by giving the
|
|
usual notice in such district, or districts, prior to said election,
|
|
unless such vacancy shall occur within sixty days prior to an
|

annual election, in which case the annual shall supersede the
|
|
necessity of said special election, and that said elections shall
|
|
be held by the judges of the several election districts when
|
|
such vacancy shall occur; and the same shall be held in the
|
|
manner prescribed by the act to which this is a supplement.
