ALLEGANY COUNTY.

 

which shall be by the said clerk recorded, certify in a form

 

similar to the certificate of the election of delegates, that the

 

ten persons by name, residents respectively of the election dis-

 

tricts aforesaid in said county, who they shall ascertain to have

 

received the greatest number of legal votes in the districts as

 

aforesaid, in which they shall severally reside, are duly elected

 

commissioners for Allegany county, to serve for the period of

 

two years from the date of thejr said election ; and that the

 

persons elected commissioners as aforesaid, shall, out of their

Vacancies;

own body, elect their president; and if any commissioner or

president.

commissioners, so elected, shall die, resign, refuse or neglect,

 

for twenty days after the notification of his election, to qualify

 

as commissioner under this act, or shall remove from said

 

county at any time within the period for which he shall have

 

been elected, the governor and council for the time being, shall

 

appoint a person qualified, as is herein before directed, in case

 

of an original election, to fill the vacancy or vacancies thus

 

occasioned, until the next annual election for delegates to the

 

general assembly, when a person or persons shall be elected in

 

the district where such commissioner or commissioners, so

 

dying, resigning, or refusing, or neglecting to qualify, or re-

 

moving from the county as aforesaid, was or were elected, in

 

like manner as at first, with like qualifications, as such com-

 

misssioner or commissioners, to serve for the residue of his or

 

their said terms.

Oath.

SEC. 2. And be it enacted. That every commissioner elected

 

or appointed as aforesaid, shall, before he enters on the duties

 

of his office, take and subscribe, before some judge or justice

 

of the peace, an oath or affirmation, that he will faithfully, dili-

 

gently, and impartially exercise the powers, and perform the

 

duties of commissioner for Allegany county, as authorized and

 

enjoined by law, according to the best of his skill and judg-

 

ment, without being influenced by favour, affection, hatred,

 

malice, or ill will ; and that he will, in making all appointments

 

to office, vote for such person among those willing to accept

 

thereof, as in his judgment and belief shall be most capable

 

and best qualified to perform the duties of such office; which

 

oath shall be recorded in a book to be kept by the clerk, among

 

the records of Allegany county court.

Corporate

SEC. 3. And be it enacted, That the commissioners elected

powers.

they are hereby constituted a body politic and corporate, by the

 

name, style, and title, of 'The Commissioners of Allegany

 

County,' and by that name shall have continued and perpetual

 

succession, and be capable in law of suing and being sued, of
