formed by them, shall be vested in, and exercised and performed

 

by, the said commissioners of Allegany county, after they shall

 

become qualified as aforesaid ; and no appointment of commis-

 

sioners of the tax for Allegany county shall thereafter be made.

 

SEC. 5. And be it enactedy That the commissioners of Alle-

act and serve as clerk to the said commissioners, who shall

 

transact all the business, and discharge all the duties, now ap-

 

pertaining to the several and respective offices of clerk of the

 

levy court and commissioners of the tax, in the same manner

 

as the clerk of Allegany county court, and the clerk of the com-

 

missioners of the tax for said county, are now by law autho-

 

rized and required to transact the same; and the person so

 

appointed shall, before he enters on the duties of his office,

 

execute a bond to the state of Maryland, to be approved of by

 

the said commissioners in the penalty of one thousand dollars,

 

conditioned for the true and faithful performance of the several

 

and respective duties imposed by this act, which bond shall be

 

recorded in the clerk's office of the county court of said county;

 

and a copy thereof, under the seal of said court, shall be as

 

sufficient evidence as the original ; and the said clerk, when

 

appointed, shall also take and subscribe the following oath or

 

affirmation, (as the case may be,) to wit :'I A. B. do swear (or

 

affirm) that, as clerk to the commissioners of Allegany county,

 

I will honestly and faithfully, to the best of my skill and judg-

 

ment, execute the duties of said office, without favour, affec-
