companies that shall be draughted in any county, shall be
arranged by the governor and council, into battalions, squad-
rons and regiments ; and from among field officers of the dis-
trict militia of such county, the governor and council shall

select, appoint and commission one major to command each
squadron or battalion, and one colonel, one lieutenant-colonel
and one major, to command each regiment; and to each regi-
ment, an extra or separate battalion, the following staff officers :
one adjutant, one quarter-master, one surgeon, two surgeon's
mates, one paymaster.

SEC. 14. And be it enacted, That in case the quota of militia
herein before mentioned, to wit: one-fifth of the whole number
enrolled in the respective counties of this state, and the city of
Baltimore, shall be supplied by volunteer companies, the gover-
nor and council shall arrange said companies into battalions,
squadrons, regiments and brigades, and appoint and commis-
sion such field officers to command said corps when so ar-
ranged, as may be requisite, and shall be recommended by
commissioned officers of the companies composing said corps
respectively, or a majority of them ; and so with regard to any
part of said quota, that shall be furnished by volunteer compa-
nies from any county or from the city of Baltimore.

SEC. 15. And be it enacted, That the governor and council
shall order the requisite arms and accoutrements belonging to
this state to be delivered from the most convenient arsenal, to
the commanding officer of every company of militia that shall
be draughted under the provisions of this act; and the said

commanding officer shall bond for the same, and distribute and
deliver said arms and accoutrements to the members of the
company under his command, and take their several bonds by
which they shall obligate themselves severally, and not jointly,
to keep the arms and accoutrements so by them respectively
received, in good order, and to re-deliver the same in like order
when legally demanded or directed, under the penalty of fifteen

SEC. 16. And be it enacted. That it shall be the duty of every
member of an uniform or draughted company, when he is about
to retire, or be discharged therefrom, to deliver, in good order,
the arms and accoutrements belonging to the state, which he
had received, to the commanding officer of his company, who
