shall receipt therefor, in duplicate, which receipt shall or may
be pleaded as a discharge of said member's bond.

SEC. 17. And be it enacted, That it shall be the duty of the
commanding officer of every uniformed and draughted company
of militia, to order every member, who is about to retire, or to
be discharged from the company under his command, to re-
deliver to him the arms and accoutrements belonging to the
state, which such member had received and had not returned ;
and in case any person shall refuse or neglect to comply with
such order, for more than four days after he shall be notified

thereof, the commanding officer, who gave the order, shall
forthwith certify such neglect or refusal to the sheriff of his
county, who shall thereupon proceed to make and collect, in

from such delinquent, by the same means, and in the same
mode and manner, that he would or might adopt or pursue, to
make the sum of any judgment debt, upon an execution issued
to enforce the same.

SEC. 18. And be it enacted, That the governor and council
shall, from time to time, adopt such measures, and give s»ch
orders, as they shall deem necessary, for the collection, preser-
vation, distribution, delivery, and re-delivery, of the arms, ac-
coutrements, and ammunition, belonging to this state; and
provide and issue such ammunition as, in their opinion, may at
any time be necessary ; and to draw on the treasurer of the

western shore for the cost and expense thereof, in favour and to
the order of the person or persons furnishing the same, or per-
forming the said service, or any part thereof.

SEC. 19. And be it enacted, That it shall be the duty of the
commanding officer of each uniformed and of each draughted
company of militia in this state, annually, in the month of Sep-
tember, to inspect the arms and accoutrements of the company
under his command, and to transmit, without delay, a report
thereof, by mail, to the adjutant-general's office, to be therein

recorded, and to cause a copy of said report to be entered in a
company book which he shall keep for that purpose, distinguish-
ing therein the arms and accoutrements that belong to the state,
from those which belong to individuals; and in case any of the
arms or accoutrements, so inspected, or subject to be inspected,
shall not be in good order, it shall be the duty of the command-
ing officer, making the inspection and ascertaining this fact, in
his discretion, to order or cause such arms and accoutrements to

be repaired by, or at the cost of the person using and having the

care thereof, and the expense of such repairs shall be paid by
such delinquent to the artificer making the same, and be re-
coverable as if the delinquent private had given the order to
such artificer.
