remitted, in any case, except by the officer authorized to approve

and accept a satisfactory excuse, or who ordered the court mar-
tial that imposed such fine, or the governor of the state, who
may remit any militia fine at his pleasure.

SEC. 4. And be it enacted, That it shall be the duty of the
commissioned officers of each company, battalion, squadron, re-
giment, brigade and division, of militia of this slate, respec-
tively and severally, to report themselves, by mail or otherwise,
to the adjutant-general of this state, on or before the first day of

November next, who shall record such of said reports in his
office, as may be received by him on or before that day ; and
every commissioned officer of the militia of this state, who shall
not report himself on or before said day, shall be deemed, and

by the adjutant-general be recorded, as having vacated his office
and forfeited his commission ; and the governor and council
shall then, or soon afterwards, appoint and commission suitable
persons, being citizens of the United States and of this state, to
fill the vacancies hereby occasioned, or which shall otherwise
exist or happen; and there shall be appointed and commis-
sioned, one adjutant-general and one quarter-master-general, in
the militia of this state; to each division of said militia, one
major-general, and two aids-de-camp, with the rank of major,
one inspector of, and one quarter-master of division, to each bri-

SEC. 6. And be it enacted, That out of the militia of this
state, enrolled as in this act directed, there shall be formed for
