CONSTITUTIONAL REVISION STUDY DOCUMENTS

Removal: No statutory provision.

Employees: Secretarial and other staff furnished by State Department of
Health.

Function: Review state policies and programs with respect to radia-
tion; establishes regulations for licensing of ionizing radia-
tion sources and equipment and all other radiation sources.

State Department of Mental Hygiene

Established By: Md. Code Ann., art. 43, § IE.

Head: Commissioner of Mental Hygiene must be experienced psychiatrist
and administrator.

Member: Commissioner appointed by governor upon recommendation of
Board of Health and Mental Hygiene.

Term: Indefinite.

Removal: Under Md. Const., art. II, § 15.

Employees: Necessary employees as provided in budget (5 all merit). Com-
missioner appoints deputy health officers who hold for an indefinite
term and are removable under the provision of Md. Code Ann., art.
64A, § 33 (Merit System). Md. Code Ann., art. 43, § 7. Commis-
sioner appoints, with approval of State Board of Health and Men-
tal Hygiene, superintendents of mental hospitals. Md. Code Ann.,
art. 59, § 19.

Function: Plans and administers programs for mental health; responsible
for supervision, care, custody, and treatment of the mentally ill.

Commission on Mental Retardation

Established By: Executive Order, 1963.

Head: Chairman selected by the Commission.

Members: 7, from various state departments, as appointed or designated
by the governor.

Employees: None.

Function: To coordinate state efforts in the area of mental retardation.

Commission on Physical Fitness

Established By: Md. Code Ann., art. 41, § 339-340—Liaison with State De-
partment of Education.
