CONSTITUTIONAL REVISION STUDY DOCUMENTS

Function: To make studies of problems relating to planning for the
health of the people of Maryland.

State Department of Health

10.01.01.01

Established By: Md. Code Ann., art. 43, § ID.
Head: Commissioner of Health.

Members: Commissioners appointed by governor upon recommendation of
Board.

Term: Indefinite.

Removal: By the governor for incompetency or misconduct under Md. Const.,
art. II, § 15; Md. Code Ann., art. 43, § ID.

Employees: Necessary assistants and employees as provided in the budget
(486 merit; 4 unclassified (part time)).

Commissioner appoints deputy health officers who hold for an
indefinite term and are removable under the provisions of Md. Code
Ann., art. 64A, § 33 (merit system). Md. Code Ann., art. 43, § 7.

Function: Responsible for the protection of public health; control of com-
municable diseases; medical and hospital care facilities.

Advisory Council on Hospital Licensing
Established By: Md. Code Ann., art. 43, § 564.
Head: No statutory provision.

Members: 9 members with professional qualifications appointed by the
governor.

Term: 5 years.

Removal: No statutory provision.

Function: Meetings are called by the State Board of Health and Men-
tal Hygiene or by any three members of the Advisory Board.
The Board makes recommendations to State Board of Health
and Mental Hygiene on the issuance or denial of licenses, the
establishment of minimum regulations, applications for
hospital construction.

Council on Medical Care

Established By: Md. Code Ann., art. 43, § 42(c)—under State Board of
Health.

Head: Chairman.
