the return of the report of the Commissioners, to
have decided by jury trial whether any and what
damage he or she has sustained; to provide for col-
lecting and paying the compensation awarded to
any person before any street or alley shall be so
opened or extended, and to enact all ordinances
from time to time necessary and proper to the ex-

ercise of the powers granted in this section; pro-
vided, that before the Mayor and Councilmen pro-
ceed to execute any of the powers vested in them
by this section, at least thirty days notice shall be
given of any application which may be made for
the passage of any such ordinance by written ad-
vertisement posted at least at three of the most
public places in the town. Upon the return of any
assessment made under any ordinance, passed un-
der this section, the Clerk of said town shall cause
a copy thereof to be for thirty days, posted at the
Post Office, in said town.

Proviso.

Sec. 2. And be it enacted by the General Assembly
of Maryland, That the Mayor and Councilmen. of
the town of Frostburg, shall designate their
Judges to hold the first election under this Act on
the first Monday in June next, for Mayor and
Councilmen, who shall qualify and hold said elec-
tion in the usual manner, and each voter shall
have printed or written on his ticket "in favor of
anincorporation," or "against an incorporation."
If a majority of the qualified voters in said town,
at said election shall vote in favor of an incorpora-
tion, then the provision of this Act shall take ef-
fect, and the election thereunder shall be valid;
bat if a majority of said voters shall vote against
an incorporation, then this Act be held as utterly
null and void, and the Acts and Sections to which
this is a supplement, shall also be null and void,
and there shall be no more elections held in said
town under its Charter of incorporation, and all
provisions of law incorporating said town shall be
void.

Sec. 3. And be it enacted. That this Act shall
take effect from the date of its passage.
